The Telangana State Consumer Disputes Redressal Commission upheld the District Consumer Commission’s order against the chit fund company, rejecting its explanation that the delay resulted from the late submission of sureties.
The case involved S. Eashwar, a self-employed mobile shop owner from Mahabubnagar, who had subscribed to a Rs 25 lakh chit operated by Kapil Chits. He was required to contribute Rs 50,000 each month for 50 months and planned to use the prize money to expand his mobile business.
How the Rs 15 lakh chit prize was won
Eashwar emerged as the successful bidder at the chit auction held on December 15, 2018. He agreed to forgo Rs 10 lakh, leaving him entitled to a prize amount of Rs 15 lakh.
Kapil Chits subsequently asked him to provide four sureties before releasing the money. Eashwar submitted the required documents, including sureties involving three income-tax payers and a head nurse working at a government hospital.
The company later disputed when the sureties had been submitted. Kapil Chits claimed they were furnished on April 28, 2019, and said the documents required verification before the prize could be released.
However, the company's own records became central to the consumer commission's assessment of the dispute.
Company records contradicted its explanation
According to the records considered by the Telangana State Consumer Commission, Eashwar had actually furnished the sureties on March 28, 2019.
The commission therefore rejected the company's claim that the documents had been submitted a month later. The final payment was made only on May 25, 2019.
Kapil Chits had paid Eashwar Rs 14,85,000 in three instalments, with the final payment of Rs 13,00,375 coming on May 25.
The company had argued that after verification of the sureties, the delay was only five days. It also pointed out that it had paid Rs 1,100 as interest for that period.
The consumer commission did not accept this explanation.
Commission calculates more than 55 days of delay
The State Commission observed that the Chit Fund Act does not prescribe a specific deadline for releasing prize money after the required sureties have been furnished.
However, it held that the absence of a statutory deadline did not mean a chit fund company could keep a successful bidder's money pending indefinitely.
The commission considered seven days to be a reasonable period for verification of the sureties. On that basis, it concluded that the payment should have been completed by April 1, 2019.
Instead, the final instalment was paid on May 25, resulting in a delay of more than 55 days.
The commission agreed with the District Consumer Commission that the delay amounted to a deficiency in service.
Rs 1,100 interest not considered adequate
Kapil Chits had already paid Rs 1,100 as interest, but the State Commission found the amount inadequate considering the length of the delay and the prize value.
It observed that interest at 12% per annum on Rs 15 lakh for roughly two months would work out to about Rs 30,000.
The commission therefore upheld the District Commission's decision to award Rs 25,000 as compensation for the delayed payment.
Dispute over Rs 17,500 insurance deduction
The case also involved a separate dispute over an insurance-related deduction of Rs 17,500.
Eashwar alleged that Kapil Chits had deducted the amount towards an insurance premium without his consent. The company disputed the allegation and maintained that the amount had subsequently been returned.
Despite the company's position, the District Consumer Commission had directed it to refund Rs 17,500.
It also awarded Rs 25,000 as compensation for the delayed prize payment and Rs 2,000 towards litigation costs.
Consumer commission upholds Rs 44,500 relief
Kapil Chits challenged the District Consumer Commission's order before the Telangana State Consumer Disputes Redressal Commission.
After reviewing the documents and arguments, the State Commission found no reason to interfere with the findings concerning the delayed payment.
It upheld the direction to refund Rs 17,500, the Rs 25,000 compensation for the delay and Rs 2,000 towards litigation expenses.
The total monetary relief therefore came to Rs 44,500.
The Telangana State Consumer Disputes Redressal Commission in Hyderabad passed the order on August 19, 2026.
